Equity One, Inc. v. Shivers — 8/26/2013
In this certified appeal, the plaintiff…appeals from the judgment of the Appellate Court, which reversed the judgment of strict foreclosure rendered by the trial court in favor of the plaintiff. The plaintiff claims that the Appellate Court incorrectly concluded that the trial court improperly had failed to conduct an evidentiary hearing to determine whether the plaintiff had standing to bring this action after the defendant…challenged the plaintiff’s standing. We agree with the plaintiff and, accordingly, reverse the judgment of the Appellate Court.
